Situation: We’ve started a triathlon training group in Nov 2008 in South Florida by using Meetup.com (we also have a facebook group). We have grown to 200 members who train and race together. We don’t sell anything – membership and training with us is completely free. Nobody is looking to make a profit. We’re not a business, just a club. In May 2009 a small business in Kansas started up with the same name as our group and they trademarked our club name. They are selling Triathlon coaching services. They just contacted us and demanded that we change our club name because they’ve trademarked it. The name has become our local identity. It is well known locally and we don’t just want to give it up. What is the legal situation? Many thanks for any advice!

YES,IF THEY HAVE THE PATENT ON THE NAME. YOU CAN SIDESTEP THIS BY JUST CHANGING ANYTHING ,HOWEVER SMALL, IN YOUR CLUB NAME. ADDING ‘the’, ‘of’, OR SOMETHING SIMILAR WILL DO.

There are several things I want to do from my home office, and wondered if I apply for a business entity….LLC, I am assuming, can I put several businesses under one name? Under one entity? I want to start a couple infopreneur websites, with affiliate marking involved, also being an Ebay seller, and have a home business with a Health and Wellness Company, and training to be a blog consultant, and a Family Manager Coach. Most all done online in some capacity or another. Any help or advice would be much appreciated and also wondered if it is wise just to have my name be the business name because it has different businesses involved.

Glad to see you are a go getter.
Yes you can have many companies under the one LLC.
as long as you use that company name when you tell people who you are.
You can look into stuff like xyz LLC dba better bakes.
Reason for the LLC is for keep you covered. So be sure that you use the company name
first in all transactions. Including bank account
If you do plan to make money, talk to your accountant friend as he may want you to be a Corp, this has a little cost, but has better coverage for many things.
Also if you start making money locally, someone will want you to get a business lic,
Try to keep everyone under one Roof, read up on DBA if you need to use different name, rules
are different by state

I am looking into creating a small business (self) at first then possible adding one or two individuals. This business is doing business presentations, consulting, personal coaching, personal organizing, and other organzing self-help both on the business and personal basis in my region. I live in western Kentucky with easy access to several businesses and persons within 2 hours drive from my house (states include TN, KY, IL, MO, ARK)? I had thought of “five star organizing and consulting” as a name? Any other ideas?

Your name should be descriptive, easy to remember, short (if possible), and available with a .com extension in case you should need a website. Write down a list of all the individual words that could go into your name and then start playing with combinations. Good luck.
